EU Ruling on Validity of Visas in Expired Passports

On 4 September 2014, in the Case C-575/12, the ECJ ruled on the question if a visa remains valid inside an expired passport.

It is one of those things that you need most when traveling – an expired passport. The second worst imaginable so far has been that a valid permit is inside an expired passport. The European Court of Justice held in the light of the Schengen Border law that a Member State must accept a valid permit as valid even when it is affixed in a canceled or expired passport because the cancellation of the concerned travel document by an authority of a third country does not imply that the visa affixed to that document is automatically invalidated.
